1. Acceptance of Terms

By accessing, registering on, or using Pgora ("the Platform"), you agree to be bound by these Terms & Conditions ("Terms"). Pgora is operated from Bangalore, Karnataka, India. If you do not agree to these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you") and Pgora ("we", "us", "our"). We reserve the right to modify these Terms at any time, with changes effective upon posting. Continued use constitutes acceptance of modified Terms.

2. Description of Service

Pgora is an AI-powered Software-as-a-Service (SaaS) platform designed for PG (Paying Guest) and hostel owners/managers. The Platform provides:

  • Room and bed management with occupancy tracking
  • Tenant onboarding, profile management, and records
  • Rent collection tracking and payment reminders
  • Grocery and supplies inventory management
  • AI-powered analytics, reports, and smart insights
  • Email notification integrations
  • Complaint management and resolution tracking

Pgora is a management tool and does not provide any physical accommodation, tenant placement, or property management services directly.

3. User Accounts

3.1 Registration

To use Pgora, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.2 Account Types

  • Admin: PG owners/managers with full access to property management features
  • User/Tenant: Limited access to tenant-specific features and information

3.3 Account Security

You must notify us immediately of any unauthorized use of your account. Pgora shall not be liable for any loss arising from unauthorized use of your account where you have failed to maintain credential security.

4. Subscription & Payments

4.1 Subscription Plans

Pgora offers subscription-based access to its features. Details of available plans, features, and pricing are available on our Pricing page.

4.2 Payment Processing

All payments are processed securely through Razorpay, our authorized payment gateway partner. By making a payment, you also agree to Razorpay's terms of service. Pgora does not store your card or bank account details.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date. You will be charged at the then-current rate for your plan.

4.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will be communicated at least 30 days in advance via email. Changes apply to the next billing cycle after the notice period.

4.5 Taxes

All prices are listed in Indian Rupees (INR). Applicable Goods and Services Tax (GST) will be charged as per Indian tax regulations and displayed during checkout.

5. User Responsibilities

As a user of Pgora, you agree to:

  • Use the Platform only for lawful purposes and in compliance with all applicable laws
  • Ensure the accuracy of all property, tenant, and financial data you upload
  • Comply with applicable local PG/hostel regulations and tenancy laws
  • Obtain proper consent from tenants before uploading their personal information
  • Not attempt to reverse-engineer, decompile, or hack the Platform
  • Not use the Platform to transmit harmful code, spam, or malicious content
  • Not share your account credentials with unauthorized parties
  • Not use the Platform to violate any person's privacy rights

6. Intellectual Property

All intellectual property rights in the Pgora platform, including but not limited to software, design, branding, AI models, logos, and content, are owned by Pgora and protected under applicable Indian intellectual property laws.

Your Data: You retain full ownership of all data you upload to Pgora. We claim no ownership rights over your property, tenant, or financial data. By using Pgora, you grant us a limited license to process your data solely for the purpose of providing and improving our services.

7. Service Availability

We strive to ensure Pgora is available 24/7. However, we do not guarantee uninterrupted service and may experience downtime due to:

  • Scheduled maintenance (with advance notice where possible)
  • Emergency security patches or updates
  • Factors beyond our control (internet outages, server issues)

We will make reasonable efforts to notify users of planned maintenance in advance.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • Pgora is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability for any claims arising from your use of Pgora shall not exceed the subscription fees paid by you in the 12 months preceding the claim.
  • We are not liable for any loss of data due to circumstances beyond our reasonable control, provided we have taken reasonable security measures.

9. Termination

9.1 By You

You may cancel your subscription and terminate your account at any time. Upon cancellation, you will retain access until the end of your current billing cycle. Your data will be available for export for 30 days after termination.

9.2 By Pgora

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. We will provide reasonable notice before termination except in cases of severe violations.

9.3 Effect of Termination

Upon termination, your right to use the Platform ceases. Sections on Intellectual Property, Limitation of Liability, and Governing Law survive termination.

10. Indemnification

You agree to indemnify and hold Pgora harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, misuse of the Platform, or infringement of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of Pgora shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

Where applicable, disputes may also be addressed under the Consumer Protection Act, 2019 and the Information Technology Act, 2000. We encourage users to first reach out to us at pgora2026@gmail.com to resolve any concerns amicably before pursuing formal legal remedies.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
